2. License to Use

All other intellectual property rights are reserved. 4. User Submissions and Ownership

Indie Game Launch allows users to submit information about games, including names, developer details, store links, images, and other related content (collectively, "User Submitted Game Content").

You retain all ownership rights to your User Submitted Game Content. Indie Game Launch does not claim any ownership over the games, their intellectual property, or the content you submit.

By submitting User Submitted Game Content to our platform, you grant Indie Game Launch a limited, non-exclusive, royalty-free, worldwide license to:

• Display and showcase your User Submitted Game Content on indiegamelaunch.com.
• Reproduce and distribute your User Submitted Game Content solely for the purpose of operating, marketing, and promoting Indie Game Launch and the games featured on it. This includes, for example, using images or details in website previews, social media posts related to Indie Game Launch, or newsletters.
• Format and adapt your User Submitted Game Content as necessary to fit the technical requirements of our website (e.g., resizing images).

This license is granted for the duration that your content remains on Indie Game Launch and will terminate upon the removal of your content from the website by you or us.

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to submit your User Submitted Game Content and to grant the limited license set forth above.
• Your User Submitted Game Content does not infringe on the intellectual property or proprietary rights of any third party.

Your submission must not:

• Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations.
• Be likely to deceive any person.

5. Limitation of Liability

In no event shall Indie Game Launch, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
